Agreements - Ante Nuptial and Past Nuptial
Minutes of Agreement are entered into between separated couples which attempt to deal with financial issues arising as a result of the separation and with a view to divorce. Such agreements usually end with a clause discharging the couples' rights to seek any further financial provision on divorce.
There are also now legally enforceable agreements entered into by a couple prior to their marriage known as Pre-Nuptial Agreements. These can ring fence wealth acquired prior to the marriage (or the second or third marriage).
Pre and past Nuptial Agreements are contracts.
A Court in some circumstances can set aside or vary such an agreement or any term where the agreement was not fair and reasonable at the time it was entered into.
